Please carefully read the Website and Intellectual Property Terms of Use (“Terms of Use”) of the International Centre for Missing & Exploited Children (“ICMEC”) before using ICMEC’s websites (the “Websites”).

By using the Websites you agree to be bound by the Terms of Use.

If you do not agree with the Terms of Use, do not use the Websites.

The Terms of Use apply exclusively to your access to and use of the Websites, including, but not limited to, www.icmec.org and www.globalmissingkids.org.

The Terms of Use forms a binding agreement between you and ICMEC. You also agree to be bound by any additional terms that may be posted regarding individuals sections of the Websites.

By using the Websites, you agree that (1) all information you submit, if any, is both truthful and accurate; and (2) your use of the Websites does not violate any applicable law or regulation.

Please review ICMEC’s Privacy Policy, which also apply to your use of the Websites.

ICMEC reserves the right to modify the Terms of Use, or any other policies/terms/conditions, relating to the Websites, at any time and in its sole discretion. Modifications will be effective immediately upon posting on the Websites. Your continued use of the Websites after the posting of modifications to the Terms of Use will constitute your acceptance of such revisions. You should review the Terms of Use, and any other applicable policies/terms/conditions, from time to time to understand the terms and conditions that govern your use of the Websites. Use of Content from the Websites
Unless otherwise indicated, ICMEC or its partners own all content on the Websites, including, without limitation, all copyrights, trademarks, service marks, designs, texts, graphics, layout, logos, pictures, audio/video clips, information or data (collectively, “Content”). All Content owned by ICMEC is protected by U.S. and international copyright, trademark and other intellectual-property laws.

Unless otherwise identified as a Permissible Use (see below), no Content can be used commercially, resold, redistributed, reproduced, displayed, republished, digitized, translated, modified, publicly displayed, publicly performed or used for other than its intended purpose. Additionally, you must refrain from any: (1) derivative use of Content; (2) use of data mining, robots or similar data gathering or extraction methods; or (3) framing, inline linking or mirroring any portion of the Websites.

Nothing in the Terms of Use or Privacy Policy should be construed as conferring in any way any license or right to any of ICMEC’s intellectual-property rights. ICMEC may terminate your access to the Websites at any time for any reason. You agree that ICMEC shall not be liable to you or any third party for terminating your access to the Websites. Your obligations under the Terms of Use, which are intended to survive termination (such as indemnification), shall survive termination of your access to the Websites.

Trademarks

ICMEC does not allow the use of its name, logo, or other marks (whether registered or not) without its express written consent in the form of a License Agreement signed by authorized ICMEC staff members.

Permissible Use of ICMEC Banners, Links and Posters
ICMEC encourages your use of ICMEC banners, posters of missing children and links to the Websites (“Permissible Uses”) to promote its mission.

You may engage in the following activities relating to Permissible Uses provided your use complies with and you agree to the following terms and conditions:

  • You will not modify Content in any way unless specifically authorized in writing by ICMEC.
  • You will not delete or alter any copyright, trademark or other intellectual-property or proprietary notices contained in Content.
  • You will not use Content: (1) for any commercial, fundraising or sponsorship purpose; (2) in any way that may create the impression ICMEC benefits from the sale of your goods or services; or (3) in any way that may create an impression of endorsement, affiliation, partnership, or sponsorship by ICMEC of any individual, entity, product, goods, services, program, event or website.
  • You will not use Content in any way that may tarnish ICMEC’s name or reputation, including, without limitation, any use that ICMEC in its sole discretion determines to be lewd, obscene, vulgar, harassing, defamatory, offensive, objectionable, or inconsistent with ICMEC’s mission.
  • You agree to immediately remove, destroy or refrain from using Content if instructed to do so by ICMEC.

Reprint Policy for ICMEC Publications

All ICMEC publications are copyrighted materials. Any individual, organization, or entity wishing to use ICMEC’s copyrighted materials (ICMEC Materials) may do so when the

  • ICMEC Materials are to be used unaltered and in their entirety for educational, noncommercial purposes. Under no circumstances are ICMEC Materials to be used for fundraising purposes.
  • ICMEC Materials will not be used in any way that may create an impression of sponsorship or endorsement by ICMEC of any individual, entity, product, service, program, or event.
  • ICMEC Materials will not be used in any way that may create an impression of any type of partnership or affiliated relationship between ICMEC and you.
  • ICMEC is clearly noted as the source of the information.
  • Intended use will not conflict with ICMEC’s standards for child safety.
  • You will immediately discontinue use of the ICMEC Materials if requested to do so by ICMEC.
  • The laws of the Commonwealth of Virginia shall govern this Reprint Policy.
  • You acknowledge ICMEC may periodically update the Reprint Policy and you are responsible for checkingwww.icmec.org to learn of any changes.
  • When meeting the criteria noted above, you may add a line of text to the reprint stating, “Provided courtesy of” and insert your name and/or logo.

ICMEC must ensure the integrity of its publications, including ensuring the essence of a publication is not lost in any reprinted excerpt. ICMEC retains the absolute and sole discretion to deny any request. If ICMEC chooses to allow the reprint of an excerpt, you must follow all other terms and conditions above.

Governing Law and Jurisdiction
